Emmitt Smith Accused of $2.5m Solar Investment Fraud
NFL legend Emmitt Smith faces a lawsuit from a Native American investment group alleging he diverted $2.5 million meant for a Texas solar farm project.
Emmitt Smith, the NFL's all-time leading rusher, has been accused of defrauding a Native American investment group of $2.5 million in a Texas solar energy scheme.
Kituwah LLC, the investment arm of the Eastern Band of Cherokee Indians, filed the lawsuit Monday in Delaware's Chancery Court. It names Smith, his business partner David Mosley and their firm, 4 13 Solutions Inc.
Kituwah says it loaned money in 2023 for the planned Project Exodus solar farm, based on projections and data the filing calls false, with promises of repayment within months. The loan came due on 1 February 2024. Kituwah claims it has "not recovered a penny" since.
The complaint alleges the funds were instead diverted to a separate creditor, co-defendant Wilson Holdings, to pay off an unrelated debt — a tactic the filing describes as "essentially, like a Ponzi scheme."
The suit alleges fraudulent inducement, breach of fiduciary duty and breach of contract. Kituwah is seeking at least $2.5 million plus interest, legal fees, expenses and further damages to be set at trial. Front Office Sports reported it was unable to reach Smith or the other defendants for comment.
Smith, 57, won three Super Bowls with the Dallas Cowboys and was named Super Bowl MVP after beating the Buffalo Bills in 1994. He finished his playing career with the Arizona Cardinals, retiring in 2004 with a record 18,355 rushing yards, and entered the Pro Football Hall of Fame in 2010.
